What "good engagement design" defensibly looks like if this theory wins

You don't need a verdict to start adjusting how you build and document engagement work. A few concrete shifts that hold up regardless of how the Meta trial resolves:

Separate "engagement" from "retention driven by value" in your own metrics language, in writing. If your team's dashboards, OKRs, and experiment write-ups only ever say "increase engagement" without tying it to a value delivered to the user (did they accomplish a goal, or did they just stay in the app longer), you have no internal record distinguishing the two — which is precisely the ambiguity this case turns on. Start writing hypothesis docs that explicitly separate "the user got more value" from "the user spent more time," even when the two numbers move together, because they won't always, and you want the record to show you knew the difference.

Age-gate your experimentation, not just your content. If your product has any material minor userbase, run a real check on whether engagement experiments are including that segment, and whether the same design pattern that's fine for an informed adult (e.g., autoplay) carries a different risk profile for a 14-year-old. "We didn't specifically target minors" is a weaker defense than "we explicitly excluded or specially reviewed minor-facing variants of engagement experiments" — the second is a design decision you can point to.

Audit your own public statements against your internal design rationale. The deception claim, not the design claim, is what turns this into a trillion-dollar case. If your company has ever published a safety page, a transparency report, or a blog post describing your product as designed with user wellbeing in mind, go check whether that statement is actually consistent with what your growth and engagement teams optimize for internally. A gap between the two is the exact pattern being litigated right now.
